Patna, Oct 17, 2026 16:10 ISTA court in Patna has handed down a two-year rigorous imprisonment sentence to a local resident for pronouncing instant triple talaq upon his wife, according to reports from the Press Trust of India.
Additional District and Sessions Judge Rajiv Ranjan Sahay convicted Naushad Ahmed under the provisions of the Muslim Women (Protection of Rights on Marriage) Act of 2019, alongside sections 323 and 341 of the Indian Penal Code, which address wrongful restraint and voluntarily causing hurt.
Along with the prison term, the court ordered Ahmed to pay a fine of Rs 6,500, stipulating an additional default sentence of one month and 22 days should he fail to settle the amount. The judge did, however, clear him of a separate accusation involving an attempted acid attack on his wife.
Legal proceedings stem from an FIR registered at the Phulwari Sharif police station in September 2022. The complainant, who had been married to Ahmed for approximately 21 years and shared three children with him, alleged that he pronounced triple talaq on September 5, 2022, following instances where he physically assaulted her and the children, and tried to throw acid at her.
Following an investigation, local police submitted a chargesheet in the matter on July 31, 2023.
Speaking to the press on Saturday, Ahmed's defense counsel, Shekhar Kumar, highlighted that the prosecution was unable to substantiate the allegations regarding the acid attack. While expressing intent to contest the remaining convictions, Kumar confirmed that his client, currently out on bail, will appeal the decision in the high court once the defense formally receives a copy of the ruling. He also verified that this represents the initial sentencing under the triple talaq legislation within the Patna district.
The Muslim Women (Protection of Rights on Marriage) Act, 2019, explicitly invalidates instant triple talaq, categorizing it as illegal and punishable by up to three years in prison coupled with a fine. The legislative measure cleared the Lok Sabha on July 25, 2019, gained Rajya Sabha approval on July 30, and took effect retroactively from September 19, 2018.
