After the State government, in a report, submitted that necessary steps will be taken to comply with the directions of the court and ensure that slaughterhouses are designed, executed and commissioned in accordance with the applicable provisions of law and guidelines of the Central Pollution Control Board (CPCB), the Madurai Bench of the Madras High Court directed the State to implement it across Tamil Nadu.A Division Bench of Justices M. Dhandapani and N.
Dilip Kumar directed the authorities not to establish any new slaughterhouses which were not in conformity with the report till such time. The existing slaughterhouses all over Tamil Nadu should be brought in tune with the report, the court said.Earlier, the court said it appeared that there was no uniform model plan or standard mechanism for the construction and waste management of slaughterhouses at the level of Town Panchayats, Municipalities and Corporations across Tamil Nadu. The court said the Supreme Court in Laxmi Narain Modi Vs.
Union of India and others, had dealt with the necessity for proper regulation, supervision and management of slaughterhouses and issued directions with regard to the functioning and periodic supervision of slaughterhouses in various parts of the country. The court said it was of the considered view that a uniform model plan and standard procedure were necessary with regard to the construction, functioning and waste management of slaughterhouses in the State, particularly at the level of Town Panchayats and Municipalities.Pursuant to the court direction, for preparing a model plan for construction of slaughterhouses, the State submitted a report. The State said the government took note of the court directions and technical requirements contained in the Revised Comprehensive Industry Document of the CPCB.
It would be suitably considered while formulating a uniform framework for the construction, operation, waste management, pollution control and monitoring of slaughterhouses under the local bodies in the State. In this regard, a time schedule was proposed for completing the necessary works, obtaining the statutory approvals, technical feasibility and tender processes. All necessary steps will be taken to comply with the directions of the court and to ensure that the slaughterhouses were designed, executed and commissioned in accordance with the applicable provisions of law and guidelines of the Central Pollution Control Board (CPCB).The court was hearing the petition filed by Kayalpattinam Municipality in Thoothukudi district challenging an order passed by the National Green Tribunal (NGT), Southern Zone, Chennai.
The NGT had issued a direction to the Municipality not to operate the slaughterhouse without complying with the conditions imposed by the Tamil Nadu Pollution Control Board. The court upheld the NGT order and disposed of the petition.
